Eva Carman is co-head of Ropes & Gray’s Securities and futures enforcement group and the co-managing partner of the firm’s New York office. Her securities enforcement work has received national recognition from The Legal 500 and Chambers & Partners, where clients describe her as ‘superb at what she does’. In addition, her work led to the firm receiving an award from the Financial Times in connection with an innovative approach to pre-regulatory examination counselling that she co-designed. In total, she has over 25 years of experience representing investment advisers in connection with SEC examinations, investigations and litigated actions. Her recent experience includes involvement in over 30 PE, real estate exams and hedge fund exams, and acting as lead defence counsel on a number of key adviser enforcement actions. The breadth of this experience gives her a unique first-hand insight into the SEC’s focus and approach. This experience combined with her deep understanding of the business enables her to give her clients practical guidance on how best to achieve the goal of a brief and benign exam or a successful resolution or trial of an enforcement action. Her practice is nationwide, having handled recent cases in seven of the SEC’s offices. While most of her successes are non-public, they include garnering a rare pre-Wells termination of a fees and expenses investigation, and successful resolution of a multi-year PE investigation. This experience along with knowledge of the regulators, sensitivity to the nuances of working in a politically charged atmosphere, and a deep understanding of her clients’ industry and businesses, make her a sought-after counsellor, advocate and speaker.
