Fernando Hernández joined Marval O'Farrell Mairal in 2002 and was promoted to partner in 2011. Fernando received his law degree from the University of Buenos Aires School of Law in 1994 and completed a Master of Laws (LLM) at Columbia University School of Law
He is a specialist in debt restructuring and insolvency and has more than 12 years of experience in transnational debt restructuring, corporate finance, banking law and capital markets. Since 2002 he has been involved in some of the largest corporate debt restructurings in Argentina and gained extensive experience in transnational private restructuring and insolvency proceedings, including pre-packaged restructuring processes, negotiation with creditors, consent request processes. and commitments to adhere to restructuring plans, cash-outs, exchange offers and tender offers, both privately and through international collective deposit systems (ie The Depository Trust Company), structuring of restructuring offers and reorganization plans, including write-offs, refinancing and debt-equity swaps; structuring and negotiation of the terms and conditions of the refinancing and / or consideration plans offered (ie debt or equity instruments), organization and monitoring of the implementation of the restructuring and reorganization plans, including mandatory exchanges and payments to the hold- out, and recognition of insolvency proceedings under Chapter 15 of the Bankruptcy Code of the United States of America.
The experience acquired by Fernando in restructuring and reorganization, together with his experience in corporate finance and capital markets, provide him with a comprehensive view of all aspects and matters involved in complex restructurings. He has written several articles on the subjects of his specialization, both locally and internationally.
Fernando is a member of the American Bar Association, the Latin American Committee of INSOL International and the Academic Committee of the NextGen Leadership Program of the International Insolvency Institute. It has been recommended for Bankruptcy / Restructuring in Chambers Latin America (Band 3). The 2014 edition reviews clients who have highlighted their “deep knowledge of the financial sector”.
